1. Introduction and Acceptance

This Terms of Service and Service Agreement ("Agreement") governs your use of the TakeAsIstan mobile application and website ("Service" or "App"). By accessing or using the App, you agree to be bound by this Agreement.

If you do not accept any part of this Agreement, please do not use the App.

The Agreement applies to all features, services, content, and functionality of the App, including AI-assisted tools, listings, messaging, and community interactions.

2. AI & ASSISTED TOOLS DISCLAIMER – IMPORTANT

Please read this section carefully. It contains key limitations regarding our AI-powered services.

2.1 How We Use AI

TakeAsIstan uses artificial intelligence (AI) to enhance your experience:

  • Automatically verify and filter listings
  • Help create compelling ad descriptions
  • Suggest relevant search results and matches
  • Provide smart recommendations based on your preferences

All AI-generated content is produced without human review and is intended to assist—not replace—your judgment.

2.2 No Liability for AI Output

We do not guarantee the accuracy, completeness, or appropriateness of any AI-generated content. You assume full responsibility for:

  • The truthfulness or relevance of any listing, description, or suggestion
  • Whether a match or recommendation suits your needs
  • Any decisions made based on AI assistance

We are not liable for:

  • Misleading, inaccurate, or incomplete information
  • Harmful, offensive, or inappropriate content
  • Financial loss, emotional distress, or missed opportunities
  • Infringement of third-party rights (e.g., copyright, privacy)

2.3 Your Responsibility

Using AI tools is at your own risk. Before acting on any AI-generated suggestion:

  • Verify details independently
  • Confirm seller/buyer credibility
  • Avoid sharing sensitive personal or financial information prematurely

AI is a tool—it is not a substitute for due diligence.

2.4 Reporting Issues

You may report concerns about AI output via the in-app feedback form. Reports help us improve, but they do not imply liability or guarantee action.

3. Service Definition and Scope

TakeAsIstan is an AI-powered classifieds platform that helps users list items and connect with verified buyers and sellers. Core features include:

  • Unlimited free listings
  • AI-powered verification to reduce spam and fake leads
  • Smart search & filtering with context-aware results
  • Secure direct messaging
  • Saved searches and bookmarks
  • Privacy protection (no caller ID exposure)
  • Local discovery based on your location

Our services are continuously improved. We reserve the right to add, modify, or remove features.

4. Account Creation and Management

Account creation is optional for basic browsing. To post listings or message others, you must create an account.

4.1 Requirements

  • You must be 18+ years old.
  • You must provide accurate and up-to-date information.
  • You are responsible for your password and account security.

4.2 Account Control

  • You can update your profile anytime.
  • You can delete your account at any time—data will be permanently removed.

4.3 Account Termination

We may suspend or terminate your account if you:

  • Violate this Agreement
  • Engage in fraudulent or harmful behavior
  • Abuse the system (e.g., spamming, fake accounts)

5. User Obligations

You agree to:

  • Use the App only for lawful purposes
  • Not impersonate others or provide false information
  • Respect other users’ privacy and safety
  • Not share your login credentials
  • Report suspicious activity immediately

6. Prohibited Activities

The following are strictly forbidden:

  • Posting illegal, harmful, or deceptive content
  • Using bots, scripts, or automated tools
  • Selling prohibited goods (e.g., weapons, stolen items)
  • Harassing or threatening other users
  • Attempting to reverse engineer or hack the App
  • Reselling or redistributing the App or its data
  • Sharing private contact info publicly

Violations may result in permanent account termination.

7. Intellectual Property

All content, design, logos, and software in TakeAsIstan are owned by us or licensed to us. This includes:

  • The App interface and user experience
  • AI-generated text and suggestions
  • Branding and trademarks

You may not copy, reproduce, or distribute any part of the App without written permission.

8. License Grant

By using TakeAsIstan, you are granted a limited, non-exclusive, non-transferable license to access and use the App for personal, non-commercial purposes—subject to this Agreement.

This license does not grant you access to source code, algorithms, or underlying systems.

9. Service Changes, Interruptions, and Termination

  • We may update, modify, or discontinue the App at any time.
  • Temporary outages may occur for maintenance or technical reasons.
  • We may terminate the service with notice. Upon termination, your data will be deleted per our Privacy Policy.

10. Limited Warranty and Liability Disclaimer

The App is provided “as is” and “as available.” We make no warranties about:

  • Continuous availability or performance
  • Accuracy of listings or matches
  • Absence of errors or bugs
  • Security against unauthorized access

To the fullest extent permitted by law, we are not liable for any direct, indirect, or consequential damages arising from your use of the App—including financial loss, emotional harm, or missed opportunities.

11. Indemnification

You agree to defend, indemnify, and hold harmless TakeAsIstan, its partners, and affiliates from any claims, losses, or damages resulting from your use of the App or violation of this Agreement.

12. Dispute Resolution and Jurisdiction

  • This Agreement is governed by the laws of the Republic of Turkey.
  • Disputes will first be attempted through negotiation.
  • If unresolved, disputes will be settled in the courts of Turkey.

13. General Provisions

  • This Agreement is the entire understanding between you and us.
  • If any provision is invalid, the rest remains enforceable.
  • We may update this Agreement at any time. Continued use means acceptance.
  • Notices will be sent via email or in-app messages.
